Welcome to Humming'Card! These Terms and Conditions (“Terms”) govern your download, access, and use of the Humming mobile application, website, digital card, and associated sustainable discount and loyalty services (collectively, the “Services”) provided by Humming'Card (registered with the Netherlands Chamber of Commerce under KVK number 42079111; “we”, “us”, or “our”).

By downloading, accessing, or using Humming, you agree to be bound by these Terms. If you do not agree to all of these Terms, you must not use our application or services.

1. Acceptance and Eligibility

• Age Requirement: You must be at least 16 years old (or have valid parental/guardian consent) to use Humming and create an account.
• Binding Agreement: By creating an account or using the app, you confirm that you have read, understood, and accepted these Terms, as well as our Privacy Policy.

2. The Humming Card & Membership

Humming'Card provides a sustainable discount card (digital and/or NFC-enabled) granting access to deals, offers, and rewards at participating independent partner businesses.

• Account Security: Membership eligibility, user profiles, and active card statuses are managed through your personal user profile. You are responsible for keeping your login credentials secure. Account sharing, transferring, or reselling of memberships is strictly prohibited.
• Third-Party Partner Offers: Discounts, perks, and promotional offers are provided directly by independent third-party partner businesses. Humming'Card acts solely as a platform to connect users with partners. We are not responsible for changes to, refusal of, or withdrawal of partner offers, nor are we liable for the quality, safety, or legality of goods/services provided by partners.
• Termination for Misuse: Fraudulent use, sharing of accounts, or abuse of the digital discount card or verification systems will result in the immediate termination of your account without notice or refund.

3. Points, Rewards, and Impact Metrics

• Accumulation: Users may accumulate digital points and track impact metrics (such as tree-planting initiatives or carbon savings) through interactions with sustainable partners and app engagement.
• No Cash Value: Points hold no cash value, cannot be transferred to other users, cannot be exchanged for fiat currency, and are subject to expiration or modification according to Humming'Card program rules.
• Program Modifications: Humming'Card reserves the right to modify, suspend, or terminate the points or rewards system at any time with reasonable notice.

4. User Conduct and Zero-Tolerance Policy

Humming'Card maintains a strict zero-tolerance policy regarding objectionable content, abusive behavior, and user-generated content (including profile pictures, usernames, or bio information).

You agree that you will not use the app or services to upload, post, or transmit any objectionable, harassing, abusive, threatening, defamatory, obscene, or discriminatory content.

You must not violate any applicable local, national (Dutch), or international law or regulation, or impersonate any person or entity.

You agree not to interfere with, disrupt, or compromise the proper functioning of the Humming platform, including its QR code scanning, NFC systems, and verification mechanisms, nor attempt to reverse-engineer, decompile, hack, or extract source code.
